Terms of Service

These Terms of Service ("Terms") govern your use of AccessWorxs (the "Service"), operated by VentureWorxs LLC ("we," "us," "our"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a company or firm, you represent that you have authority to bind that entity, and "you" refers to that entity.

1. The Service

AccessWorxs is an automated web accessibility scanning platform. It crawls websites you specify, evaluates pages against WCAG success criteria using automated rules, computes accessibility scores, and generates reports, including PDF compliance reports and VPAT/ACR documents.

Automated scanning is a first pass, not an audit. Automated tools detect only a subset of accessibility issues. Scan results, scores, and generated reports do not constitute legal advice and are not a certification, guarantee, or warranty of compliance with the ADA, Section 508, the European Accessibility Act, AODA, or any other law or standard. You are responsible for how you interpret and present results to your own clients.

2. Accounts

You must provide a valid email address to use the Service. You are responsible for all activity under your account, including activity performed with API keys you create. Keep your credentials and API keys confidential; notify us promptly at info@accessworxs.com if you believe your account or a key has been compromised.

3. Authorization to Scan

You may only scan websites you own or are explicitly authorized to scan. By initiating a scan of any domain, you represent and warrant that you own the domain or have obtained authorization from its owner sufficient to permit automated crawling and accessibility evaluation of it, including any pages behind authentication. Scanning competitors' websites or any site without authorization is prohibited and is grounds for immediate account termination.

Where you store login credentials with the Service for authenticated scanning, you additionally represent and warrant that you are authorized to use those credentials for this purpose. You are solely responsible for the consequences of scans you initiate, including any effect on the target site.

4. Acceptable Use

You agree not to:

• Scan any website without the authorization described in Section 3;
• Use the Service to probe, attack, disrupt, or gain unauthorized access to any system;
• Circumvent plan limits, rate limits, or access controls, or share one account across multiple firms to avoid subscription fees;
• Resell or provide the Service to third parties except as contemplated by your plan (e.g., delivering reports and client-portal access to your own clients);
• Use the Service to violate any applicable law.

5. Plans, Billing, and Trials

Paid plans are billed monthly in advance through Stripe, our payment processor. Plan limits (pages per scan, projects, seats, scan frequency, and features) are described on the pricing page and enforced by the Service; we may adjust plan definitions prospectively.

Free trial. The free trial requires a payment method and automatically converts to a paid Basic subscription at the end of the trial period unless you cancel before the trial ends. We send a reminder email before the first charge.

Cancellation. You may cancel at any time through the Manage Billing option in your dashboard. Cancellation takes effect at the end of the current billing period; you retain plan access until then, after which your account is downgraded.

6. Refunds

Subscription fees are non-refundable, and we do not prorate partial billing periods. If you cancel, you will not be charged again, but amounts already paid are not returned. If you believe you were charged in error — for example, a charge after a timely cancellation, or a duplicate charge — contact info@accessworxs.com within 30 days of the charge and we will review and, where warranted, refund it. Nothing in this section limits any non-waivable statutory refund rights that may apply to you.

7. Your Data and Content

You retain all rights to the content of the websites you scan and to the credentials you store. You grant us the limited rights needed to operate the Service: crawling and rendering pages you direct us to, storing findings, screenshots, and generated reports, and processing stored credentials solely to perform authenticated scans you configure. Stored credentials are encrypted at rest and are never displayed back to you or to us in plaintext. Data handling details, including retention periods and subprocessors, are described in our Privacy Policy.

8. AI-Generated Content

Remediation suggestions may be generated by artificial intelligence. They are provided as-is, may be inaccurate or incomplete, and should be reviewed by a qualified person before implementation. You are responsible for any code or content you deploy based on them.

9. API Access

Plans that include API/MCP access allow you to create bearer-token API keys. Keys are read-only, expire automatically, and may be revoked by you at any time. You are responsible for requests made with your keys. We may throttle or revoke keys that we reasonably believe are compromised or abusive.

10. Availability and Changes

We aim for high availability but do not guarantee uninterrupted service, and the Service is provided without a service-level agreement. We may modify, suspend, or discontinue features with reasonable notice where practical. We may update these Terms; material changes will be announced by email or in the dashboard, and continued use after the effective date constitutes acceptance.

11. Suspension and Termination

We may suspend or terminate your account for breach of these Terms — in particular Section 3 (unauthorized scanning) and Section 4 (acceptable use) — for non-payment, or where required by law. You may stop using the Service and cancel at any time. Upon termination we will delete or anonymize your data in accordance with the Privacy Policy; you may request deletion earlier at any time.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT SCAN RESULTS ARE COMPLETE OR ERROR-FREE, OR THAT USE OF THE SERVICE WILL RESULT IN COMPLIANCE WITH ANY LAW OR STANDARD.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VENTUREWORXS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You will indemnify and hold harmless VentureWorxs LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of Section 3 (Authorization to Scan), your misuse of stored credentials, or your violation of applicable law in connection with the Service.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
